  1. General Provisions

FarmyLand Limited Liability Company (hereinafter referred to as the Company) adheres to the principles of confidentiality and inviolability of information received from the Company’s customers within the framework of providing services for sale of goods, maintenance and repair of agricultural machinery (hereinafter referred to as the Services).

The Company guarantees the safety of information with limited access and protection of personal data of users of services and buyers of goods (hereinafter – Users), including when using the official website of the company https://www.farmyland.com.ua/en/ (hereinafter – the Site), mobile applications, customer service chat rooms, company pages in messengers and social networks.

Privacy Policy (hereinafter – the Policy) is aimed at publicly informing Users about the procedure of collection, processing, storage, transfer of personal data and information provided within the framework of the Company’s operation, use of the site https://www.farmyland.com.ua/en/.

By cooperating with the Company (meaning the purchase of goods and ordering services), and continuing to use the Site, the User agrees to all the terms and conditions of the Policy.

  1. Collection of personal data

2.1 Personal data – information or a set of information about the User who is identified or can be specifically identified. Non-personalized information – information that is not linked to a specific Service User.

The personal data processed by the Company covers:

  • contact data provided by Users when cooperating with the Company (surname, first name, patronymic, telephone number, e-mail addresses, etc.);
  • information used to pay for goods and services;
  • order numbers and history, etc.

2.2 Information is provided during the User’s contacts with the Company, including via the Website, mobile applications, advertising in social networks and the like. The data is transferred by Users voluntarily in order to ensure that the Company can fulfill its obligations for goods and services.

3.1 This Privacy Policy establishes the obligations of the Administration of the site https://www.farmyland.com.ua/en/ about non-disclosure of personal data that the User provides at various requests of the Administration of the site (for example, when registering on the Site, placing an order, filling out a feedback form, using the services “Order a call”, “Find out the price”, “Send an application”, etc.).

3.2 The personal data allowed for processing within the framework of this Privacy Policy shall be provided by the User by filling in special forms on the Website and may contain the following information:

  • surname, first name, patronymic of the User;
  • contact phone number of the User;
  • electronic mail (e-mail) addresses;
  • the User’s place of residence and other data.

The administration of the site also makes efforts to protect personal data that are automatically transmitted in the process of visiting the pages of the Site:

  • IP addresses;
  • information about your browser (or other application that accesses the Site);
  • access time;
  • addresses of visited pages;
  • referrer (address of the previous page), etc.

3.3 Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) shall not be intentionally disclosed.

4.1 As part of the operation of its Site, the Company may collect certain information using technologies such as cookies, pixels and local storage (in the User’s browser or mobile device).

Cookies are small text files that store information directly on the User’s computer, cell phone or other device. Cookies do not activate applications or transmit viruses.

Pixels are small digital images that are part of codes on web pages that allow another server to measure the visibility of a web page, and are often used in conjunction with cookies. The code tracks if/when (and on which page)a pixel is loaded to indicate that the User is interacting with a page or part of a page on the Site.

  1. Purposes of collecting the User’s personal information

5.1 The processing of the User’s personal data by the Company will be carried out for the purpose of realization of relations in the sphere of economic activity.

  1. Personal data retention period

6.1 Personal data must be stored and processed on appropriately secured servers for the time necessary to fulfill the purposes for which it was collected, including legal, tax and accounting obligations, as well as marketing and reporting purposes.

6.2 In the case of data processing for the purpose of concluding and executing an agreement, the data shall be processed until the termination or expiration of the agreement.

6.3 In case of data processing for the purpose of fulfillment of the company’s legal obligations arising from the applicable Ukrainian legislation, the data shall be processed until the termination of the agreement and after its termination no longer than for the period arising from legally justified interests or legal requirements (processing for statistical and calculation purposes, claims handling).

6.4 Personal data relating to cookies are stored for a period corresponding to their life cycle or until the User deletes them himself.

  1. Transfer of personal data

7.1 Based on the applicable regulations on personal data protection, the Company may provide data to such data subjects:

7.1.1 Third Party Service Providers: The Company may use services provided by third parties (such as postal operators, carriers, courier services, etc.) to provide certain elements of its Services. Such third parties are not authorized to use users’ personal data for their own purposes. Processing of personal data by third parties is carried out solely at the Company’s request for a specific purpose, in accordance with the Company’s instructions.

7.1.2 Law enforcement authorities and other controlling bodies: The Company reserves the right to exchange information with state authorities in accordance with the requirements of the legislation of Ukraine for the following purposes:

  • protection against fraud and abuse;
  • investigation of possible violation of Ukrainian law or other probable violations of the User Agreement.

7.2 The Company may provide personal data of Users at the request of the relevant authorities, provided that such requests are submitted in accordance with the requirements of the legislation of Ukraine.

Under the Privacy Policy, the Company agrees not to otherwise share or sell any of the User’s personal data.

  1. Information protection and data security

8.1 Confidential information, personal data and non-personalized information are stored on the Company’s internal resources.

The Company’s web resources have taken sufficient measures to protect information, but please note that there is no absolutely safe and error-free way to transmit data via the Internet.

8.2 The Company is not responsible for the functioning of servers, Internet access service providers, the work of third parties through whose fault it may be impossible or limited access to the Site, possible leakage of information through the fault of third parties, as well as for the disclosure of personal data by the User in mobile applications, application program interfaces and applications.

8.3 The information posted on the Company’s web resources is protected by the current legislation governing intellectual property rights. Replication, translation, archiving, copying to other electronic media of the information that is posted is prohibited.

9.1 The applicable privacy regulations grant the User the following rights related to the processing of personal data:

  • the right to access their personal data (paragraph 3, part 2, article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to make a reasoned demand to change or destroy his/her personal data by any owner and controller of personal data, if these data are processed illegally or are inaccurate (paragraph 6, part 2, article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to make reservations on the restriction of the right to process their personal data upon giving consent (paragraph 10, part 2, Article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to transfer information about an individual with the consent of the subject of personal data (paragraph 1 of Article 14 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to submit a reasoned request to the personal data controller objecting to the processing of personal data (paragraph 5, part 2, Article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to protection from an automated decision that has legal consequences for him (paragraph 13, part 2, Article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • the right to file complaints about the processing of their personal data with the Commissioner or the court (paragraph 8, part 2, Article 8 of the Law of Ukraine “On Protection of Personal Data”);
  • and other rights in accordance with the current legislation of Ukraine.

9.2 Each User who has consented to the processing of his/her personal data for the purpose of using the Services available on the Website has the right to withdraw his/her consent at any time. Withdrawal of consent does not affect compliance with the legislation of Ukraine on the processing of personal data, which was carried out on the basis of consent prior to its withdrawal.

  1. User’s Consent

10.1 In accordance with the Law, the User’s consent to the terms of this Policy means that the User voluntarily provides the Company with his/her consent to the processing of his/her personal data in electronic form and/or in the form of personal data files of the business entity’s clients for the purpose of realization of relations in the sphere of economic activity.

10.1 This Privacy Policy applies to the User from the moment when during the use of the Site he agreed to the terms of this Privacy Policy when transferring his personal data and as long as the Site stores any information about the User, including personal data.

  1. Additional information

11.1 The Company reserves the right to change the Privacy Policy. In this case the relevant changes will be made to the electronic version of this Policy posted on the Website.
